Welcome to WordWhiz, an educational web game designed to assist children aged 3 to 10 in developing reading, typing, and word comprehension skills. By accessing or using WordWhiz, you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the game.

1. Eligibility and Parental Responsibility

  • Children's Use: WordWhiz is intended for use by children aged 3 to 10. However, children under the age of 13 must have a parent or legal guardian ("Parent") create an account and supervise their use of the game.
  • Parental Supervision: Parents are responsible for ensuring that their child's use of WordWhiz complies with these Terms. The game is designed to encourage joint participation between parent and child.
  • Parental Dashboard: All account management, including payments and settings, are accessible through the Parent Dashboard.

2. Account Registration and Communications

  • Registration: To access certain features, Parents must register for an account. During registration, you agree to provide accurate and complete information.
  • Email Communications: By registering, you consent to receive informational emails about WordWhiz, including updates and educational content. You may opt out of these communications at any time through your account settings.

3. Payments and Subscriptions

  • Payment Processing: All payments for subscriptions or in-game purchases are managed exclusively through the Parent Dashboard.
  • Refunds: Refund policies are outlined in the Parent Dashboard. Please review them carefully before making any purchases.

4. User Conduct and Safety

  • Appropriate Use: Users agree to use WordWhiz in a manner that is safe and appropriate. Any misuse of the game, including attempts to access unauthorized areas or share inappropriate content, is prohibited.
  • No Liability for Misuse: WordWhiz is not liable for any consequences resulting from misuse of the game by a child. Parents are responsible for supervising their child's use of the game.

5. Privacy and Data Collection

  • Children's Privacy: We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13 without verifiable parental consent.
  • Data Use: Information collected is used solely to enhance the educational experience and is not shared with third parties without consent.

6. Intellectual Property

  • Ownership: All content within WordWhiz, including text, graphics, and software, is the property of WordWhiz and is protected by intellectual property laws.
  • License: WordWhiz grants you a limited, non-exclusive, non-transferable license to access and use the game for personal, non-commercial purposes.

7. Disclaimers and Limitation of Liability

  • Educational Purpose: WordWhiz is provided for educational purposes only and does not guarantee specific learning outcomes.
  • No Warranty: The game is provided "as is" without warranties of any kind.
  • Limitation of Liability: WordWhiz is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the game.

8. Termination

  • Termination by User: You may terminate your account at any time through the Parent Dashboard.
  • Termination by WordWhiz: We reserve the right to suspend or terminate your access to the game at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users.

  • Modifications: We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.
